1. Agreement to Terms
By accepting a written estimate, signing a contract, making a deposit, or allowing River City Painting to begin work on your property, you agree to these Terms and Conditions.
River City Painting may be referred to as “Company,” “we,” “us,” or “our.” The customer may be referred to as “Client,” “you,” or “your.”
Please read these terms carefully before approving any work. If you do not agree with any part of these terms, please notify us before the project begins.
2. Services Offered
River City Painting provides professional painting and related services in San Antonio, Texas, and surrounding areas, including Wimberley, Driftwood, Kyle, Boerne, and Hays County.
Our services include:
- Residential interior painting
- Residential exterior painting
- Commercial interior painting
- Commercial exterior painting
- Cabinet painting and refinishing
- Door painting and refinishing
- Fence and deck painting and maintenance
- Surface preparation, priming, and repair
- Multi-family property painting
- Medical facility and office painting
All services are performed by licensed, insured, and PCA-Certified professionals using premium, professional-grade paints and coatings suitable for San Antonio’s climate.
3. Estimates and Quotes
3.1 Free Estimates
River City Painting provides free on-site estimates. Each estimate is based on a physical inspection of the project area, the discussed scope of work, and current material costs.
Written estimates are valid for thirty (30) days from the date of issue.
3.2 Scope Changes
Any changes to the approved scope of work may require a written change order. This may include additional surfaces, colors, coats, repairs, or other work not included in the original estimate.
Additional charges may apply. Work on scope changes will not begin until the Client approves the change order in writing.
3.3 Unforeseen Conditions
If hidden damage, dry rot, lead paint, mold, structural issues, or other unforeseen conditions are discovered during the project, River City Painting will notify the Client.
Costs to address these conditions are not included in the original estimate and will be provided through a separate change order.
4. Payment Terms
4.1 Deposit
A deposit of up to fifty percent (50%) of the total project cost may be required before work begins. The exact deposit amount will be included in the written project agreement.
4.2 Final Payment
The remaining balance is due upon substantial completion of the project and after the Client’s walk-through inspection.
“Substantial completion” means all agreed-upon work has been completed, with only minor punch-list items remaining.
4.3 Accepted Payment Methods
River City Painting accepts:
- Check
- Cash
- Major credit cards
Payment details will be confirmed at the time of agreement.
4.4 Late Payments
Balances not paid within ten (10) days of the due date may accrue a late fee of 1.5% per month, equal to 18% per year, on the outstanding balance.
River City Painting reserves the right to suspend or terminate work on any project with an unpaid balance.
4.5 Returned Checks
A $35.00 fee will be charged for any returned check, in addition to any fees charged by the Company’s financial institution.
5. Scheduling and Project Timeline
5.1 Start Dates
Project start dates are scheduled after the required deposit is received and the project agreement is completed.
River City Painting will make reasonable efforts to begin and complete work within the timeline discussed with the Client.
5.2 Weather Delays
Exterior painting may be delayed by weather conditions such as rain, high humidity, extreme heat, or temperatures outside the acceptable range for paint application.
River City Painting is not responsible for weather-related delays, and pricing will not be adjusted because of such delays.
5.3 Access to Property
The Client is responsible for providing reasonable access to the work area on scheduled workdays.
If the crew arrives at the scheduled time but cannot access the property or begin work due to circumstances within the Client’s control, the Client may be charged for the trip.
5.4 Cancellations
Cancellations made fewer than forty-eight (48) hours before the scheduled start date may result in forfeiture of the deposit or a cancellation fee to cover scheduling and material costs.
6. Client Responsibilities
To help ensure a smooth project, the Client agrees to:
- Remove or relocate fragile, valuable, or sentimental items from work areas
- Secure pets away from the work area during the project
- Provide access to water and electrical outlets as needed
- Notify River City Painting of any known hazardous materials, including asbestos or lead paint
- Ensure surfaces are free from personal items, furniture, or obstructions
- Be available or assign an authorized representative for the final walk-through
River City Painting will protect floors, furniture, landscaping, and non-painted surfaces with drop cloths and masking materials. However, Clients are strongly encouraged to remove personal items before work begins to help prevent accidental damage.
7. Workmanship Warranty
7.1 Warranty Coverage
River City Painting provides a limited workmanship warranty on completed painting projects.
This warranty covers application defects such as peeling, bubbling, or flaking paint caused by improper application technique for one (1) year from the date of project completion.
7.2 Warranty Exclusions
This warranty does not cover:
- Normal wear and tear
- Fading due to UV exposure
- Weathering
- Damage caused by water intrusion, moisture, or structural movement
- Paint failure caused by pre-existing surface conditions not disclosed by the Client
- Damage caused by work performed by other contractors
- Color fading or sheen changes related to the paint product itself
- Work not performed by River City Painting
7.3 Paint Manufacturer Warranty
River City Painting uses professional-grade paint products that may include manufacturer warranties.
Clients are encouraged to keep paint brand and color information for any warranty claims made directly with the manufacturer.
7.4 Warranty Claims

River City Painting will inspect the issue within a reasonable time. If the issue is covered under warranty, the affected area will be repaired or repainted at no charge.
8. Insurance, Licensing, and Certifications
River City Painting carries general liability insurance and workers’ compensation coverage as required by the State of Texas.
The Company is a licensed painting contractor and holds PCA certification. Proof of insurance and licensing is available upon written request.
River City Painting is not responsible for pre-existing property damage, structural defects, or conditions unrelated to the painting services performed.
9. Safety and Site Conduct
River City Painting follows safe work practices on every job site. Our crews follow OSHA guidelines and industry safety standards.
The Client agrees to:
- Keep children and unauthorized persons away from active work areas
- Inform the Company of any known property hazards before work begins
- Avoid interfering with or directing the crew during active work unless coordinated with the project supervisor
River City Painting reserves the right to stop work if unsafe conditions are present and cannot be resolved immediately.
10. Property Damage
River City Painting takes precautions to protect your property.
If accidental damage is caused directly by our crew, the Client must notify us in writing within forty-eight (48) hours of discovery.
River City Painting will assess the damage and, if confirmed to be our responsibility, may arrange repair or reimbursement at our discretion.
The Company is not responsible for damage caused by pre-existing conditions, acts of nature, or conditions outside our reasonable control.
The Company’s liability is limited to the value of the work performed under the current agreement.
11. Color Selection and Materials
The Client is responsible for selecting paint colors before the start of the project.
River City Painting will use the colors, brands, and sheens listed in the project agreement. Once a color has been applied, any requested color change may result in additional material and labor charges.
River City Painting recommends and uses professional-grade, low-VOC paint options designed to perform in San Antonio’s heat and humidity.
If the Client requests a specific paint brand or product not typically used by the Company, the Client accepts responsibility for that product’s performance.
12. Cleanup and Project Completion
At the end of each workday and upon final project completion, River City Painting will:
- Remove drop cloths, masking materials, and paint-related debris
- Dispose of used materials according to applicable regulations
- Clean the work area and return it to its pre-project condition as much as possible
- Complete a final walk-through with the Client to address any concerns before final payment
The Client’s signature on the completion form or final payment confirms acceptance of the completed work.
13. Privacy and Photography
River City Painting may photograph completed projects for use in our portfolio, website, and marketing materials.
Property addresses and personally identifiable information will not be published without the Client’s written consent.
If you do not want your project photographed, please notify River City Painting in writing before work begins.
14. Dispute Resolution
If a dispute arises from services provided under these Terms, both parties agree to first attempt to resolve the matter through good-faith negotiation.
If a resolution cannot be reached, disputes shall be submitted to mediation in Bexar County, Texas, before legal action is pursued.
These Terms and Conditions are governed by the laws of the State of Texas. Any legal proceedings shall take place in the courts of Bexar County, Texas.
15. Limitation of Liability
To the maximum extent allowed by law, River City Painting’s total liability for any claim related to services provided shall not exceed the total amount paid by the Client for the specific project involved.
River City Painting shall not be liable for indirect, incidental, consequential, or punitive damages.
16. Modifications to Terms
River City Painting may update or modify these Terms and Conditions at any time.
Changes will be posted on the Company website at rivercitypaintingsa.com. Continued use of our services after changes are posted means you accept the updated Terms.
